I'm not surprised she won, because she's JKR, but should she have won? I still don't see how the Lexicon did anything different than any other people who write and publish books about other people's work.

I absolutely think she should have won. Other derivative works, like the ones on LotR and Narnia that the Lexicon folks tried to use as an example include analysis and commentary. Even the already published unauthorized HP books do that. The Lexicon book had no analysis or commentary. It was just summary. That makes all the difference.

Totally agree. I have to wonder what those publishers were thinking when they signed that project. They had to have known that if they didn't have permission from JKR to use so freaking much of her work that they would be in a bunch of legal trouble. And I highly doubt that publicity from the case is worth the money it has cost them.
